UAE Article 51 Read 2 November 2026

Resigning does not cut your UAE gratuity. The old scale is not in the current law.

Search for end-of-service pay and half the results still tell you that resigning early costs you a third or two thirds of it. That rule belongs to a law the UAE replaced in 2022.

0 times the word resignation appears in Federal Decree-Law No. 33 of 2021. The reduction has no basis in the text.

What changed

Federal Decree-Law No. 33 of 2021 came into force on 2 February 2022 and replaced the labour law that had governed the private sector since 1980. Under the old law, a worker who resigned before completing a set number of years received a fraction of the gratuity: less than a third after one year, two thirds after three, the whole amount after five.

That scale was tied to resignation. The new law is not. It grants the gratuity on the end of service and then sets the calculation, with no reference to how the service ended.

The evidence is an absence, and absences are checkable

I searched the full text of the decree on the UAE Legislation portal for the word resign and its variants. It appears zero times. Article 51, which sets the whole calculation, reads:

“The foreign full-time Worker, who has completed one or more years of continuous service, is entitled to an end-of-service gratuity upon the end of his service, calculated according to the basic wage, as follows: a. The wage of twenty-one (21) days for each year of the first five years of service. b. The wage of thirty (30) days for each year in excess of that.”

End of service, not termination by the employer. The entitlement is triggered by the contract ending, not by who ended it. The exceptions the law does provide for are narrow and specific, and resignation is not among them.

So what does resignation change

Two things, neither of them the rate.

Timing. A resignation triggers a notice period, and the end-of-service date is what the calculation runs to. Leave earlier and the service is shorter, which lowers the number for the ordinary reason.

The one year floor. Article 51 gives the gratuity to a worker who has completed one or more years of continuous service. Resign at eleven months and the entitlement has not started yet. That applies to every ending, not just resignation.

Worked example Basic salary AED 8,000. Resign after 4 years and 6 months. Daily basic wage is 8,000 ÷ 30 = 266.67. You have 4 full years at 21 days, which is 84 days, plus half a year at 21 days in proportion, which is 10.5 days. That is 94.5 days, or AED 25,200. The old scale would have paid two thirds of that. The current law pays all of it.

Why the wrong answer is still everywhere

Because the old rule was true for forty years, and content about it outlived the law. A guide written in 2019 still ranks, still gets copied, and still says one third after a year. Some of those pages were updated with the new law's name at the top and the old arithmetic underneath.

If an HR department or an employer quotes the scale to you, ask which article of which law. The scale is not in Article 51, and Article 51 is where the money is decided.
